1. Purpose
This Acceptable Use Policy ("AUP") governs your use of ChatBD's WhatsApp Business automation service. By using our Service, you agree to comply with this policy and all applicable laws and regulations.
2. Prohibited Activities
2.1 Spam and Unsolicited Messages
You must NOT use ChatBD to send:
- Spam: Unsolicited bulk messages to users who have not opted in
- Chain Messages: Messages that request forwarding to others
- Phishing: Messages designed to deceive recipients
- Cold Outreach: Messages to people who have not initiated contact with your business
Note: WhatsApp Business API has strict anti-spam policies. Violations can result in your business phone number being banned by WhatsApp.
2.2 Illegal Content and Activities
You must NOT use ChatBD for any illegal purposes, including but not limited to:
- Drug trafficking or promoting controlled substances
- Weapons sales or illegal arms dealing
- Human trafficking or exploitation
- Money laundering or financial fraud
- Copyright infringement or piracy
- Identity theft or impersonation
- Violating export control laws
- Any activity prohibited under Bangladesh law
2.3 Harmful or Offensive Content
You must NOT send messages containing:
- Adult Content: Pornography, sexual content, or dating services
- Hate Speech: Content promoting hatred based on race, religion, ethnicity, gender, etc.
- Violence: Graphic violence, gore, or threats
- Harassment: Bullying, stalking, or intimidation
- Discrimination: Content that discriminates against protected groups
- Self-Harm: Content promoting suicide or self-injury
2.4 Fraud and Scams
Prohibited fraudulent activities include:
- Pyramid schemes or multi-level marketing scams
- Investment scams or get-rich-quick schemes
- Fake products or counterfeit goods
- False advertising or deceptive practices
- Credit card fraud or payment scams
- Impersonating ChatBD staff or other businesses
2.5 WhatsApp Policy Violations
You must comply with WhatsApp's policies, including NOT:
- Using unauthorized WhatsApp API clients
- Sending messages from multiple accounts simultaneously (except as allowed by WhatsApp)
- Scraping WhatsApp user data
- Circumventing WhatsApp rate limits
- Violating WhatsApp Commerce Policy (if selling products)
- Using ChatBD with a personal WhatsApp account (must be WhatsApp Business)
2.6 System Abuse
You must NOT:
- Attempt to gain unauthorized access to our systems
- Reverse engineer or decompile our software
- Use automated tools to scrape or harvest data
- Overload our servers with excessive requests
- Circumvent usage limits or billing mechanisms
- Share your account credentials with others
- Create multiple accounts to abuse free trials
2.7 Reselling and Unauthorized Use
Unless explicitly authorized, you must NOT:
- Resell ChatBD services to third parties
- Use ChatBD to provide competing services
- White-label our service without permission
- Sublicense your account to others
3. Acceptable Uses
3.1 Legitimate Business Communications
ChatBD is designed for:
- Responding to customer inquiries
- Providing customer support
- Sending order confirmations and updates
- Sharing appointment reminders
- Sending transactional notifications
3.2 Marketing with Consent
You may send promotional messages ONLY if:
- Recipients have explicitly opted in to receive marketing
- You provide a clear way to opt-out
- You honor opt-out requests immediately
- Messages are relevant to your business
4. User Responsibilities
4.1 Compliance
You are responsible for:
- Ensuring all messages comply with applicable laws
- Obtaining necessary consents from message recipients
- Maintaining accurate customer opt-in/opt-out records
- Promptly responding to customer complaints
- Monitoring automated messages for accuracy
4.2 Data Privacy
You must:
- Comply with applicable data protection laws (GDPR, Bangladesh Digital Security Act, etc.)
- Have a valid legal basis for processing customer data
- Provide clear privacy notices to your customers
- Respond to data subject requests (access, deletion, etc.)
- Report any data breaches to us immediately
4.3 Content Responsibility
You are solely responsible for:
- All content sent through ChatBD
- AI responses generated based on your training data
- Customer interactions and outcomes
- Any legal claims arising from your use of the Service
5. Monitoring and Enforcement
5.1 Right to Monitor
We reserve the right to monitor your use of the Service to ensure compliance with this policy. This may include reviewing message content, usage patterns, and customer complaints.
5.2 Reporting Violations
If you become aware of any violations of this policy, please report them to: abuse@chatbd.com
5.3 Investigation
If we receive a complaint or detect suspicious activity:
- We will investigate the matter promptly
- We may temporarily suspend your account pending investigation
- We will contact you for clarification
- We will take appropriate action based on our findings
6. Consequences of Violations
6.1 Enforcement Actions
Depending on the severity and frequency of violations, we may:
- First Offense (Minor): Warning via email
- Second Offense: 7-day account suspension
- Third Offense or Serious Violation: Permanent account termination
6.2 Immediate Termination
The following violations result in immediate account termination without warning:
- Illegal activities
- Adult content or child exploitation
- Scams or fraud
- Severe spam (1000+ unsolicited messages)
- Security breaches or hacking attempts
6.3 No Refund
If your account is suspended or terminated for violating this policy, you will NOT receive a refund for any unused portion of your subscription.
6.4 Legal Action
We reserve the right to:
- Report illegal activities to law enforcement
- Cooperate with legal investigations
- Pursue legal action for damages caused by your violations
7. Appeals Process
7.1 How to Appeal
If you believe your account was suspended or terminated in error:
- Email us at: appeals@chatbd.com
- Include your account email and explanation
- Provide evidence supporting your case
- We will review within 5 business days
7.2 Appeal Decision
Our decision on appeals is final. If your appeal is denied, you may not create a new account.
8. Changes to This Policy
We may update this Acceptable Use Policy from time to time. Material changes will be communicated via:
- Email notification
- In-app notification
- Updated date at the top of this page
Continued use of the Service after changes constitutes acceptance of the updated policy.
